Plain English summary: Use CoHostOS to manage your rental business. Don't abuse it or use it for illegal purposes. We provide it as-is and may suspend accounts that violate these terms. You own your data.

1. Acceptance

By downloading, accessing, or using CoHostOS (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, don't use the Service. If you're using CoHostOS on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

CoHostOS is a property management platform for short-term rental hosts, co-hosts, property managers, and landlords. It includes iOS and macOS native apps and web-based portals at cohostos.co. Features include booking management, owner statements, tenant/lease management, direct booking, maintenance tracking, and related tools.

You retain all ownership of data you enter into CoHostOS (property information, tenant data, booking records, etc.). You grant us a limited license to store and process that data solely to provide the Service. See our Privacy Policy for details on how we handle your data.

You are responsible for ensuring you have the legal right to store personal information about tenants, owners, and guests in the Service, and for complying with applicable data protection laws.

7. Tenant and Owner Portals

CoHostOS provides web portal links for your tenants and property owners. You are responsible for ensuring portal links are shared only with the intended recipients. CoHostOS is not responsible for unauthorized access resulting from you sharing links with incorrect parties.

8. Third-Party Integrations

CoHostOS integrates with third-party services (Stripe, Twilio, Resend, PriceLabs, August, Igloohome, etc.). Your use of these services is subject to their respective terms. CoHostOS is not responsible for third-party service outages, errors, or changes in API availability.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COHOSTOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold CoHostOS harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or any reason with 30 days notice. Upon termination, you may export your data for 30 days. We may terminate immediately for serious violations without notice.

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration in accordance with JAMS rules, except either party may seek injunctive relief in court.

14. Changes to Terms

We may update these Terms. We will provide 30 days notice for material changes. Continued use after the effective date constitutes acceptance.
